Terms of Use & Membership Agreement

PARTIES

Service provider / Seller

User: any natural or legal person who visits https://www.burtech.com.tr ("the Platform"), places an order, or signs in to the dealer portal.

ARTICLE 1 — DEFINITIONS

• Platform: the BURTECH website and its subsystems (wholesale catalogue, retail dealer storefront, dealer portal, admin panel).
• Buyer / Customer: a person or company placing an order as a guest.
• Dealer: an authorised reseller with a BURTECH dealership and portal credentials.
• KVKK / TKHK / ETK: Turkish Laws No. 6698 (data protection), No. 6502 (consumer protection) and No. 6563 (e-commerce).

ARTICLE 2 — SUBJECT AND SCOPE

2.1. This agreement governs the use of the Platform and the parties' rights and obligations.

2.2. Services offered: browsing and searching the BURTECH catalogue; pallet-based wholesale (B2B) ordering; finding the nearest authorised dealer and ordering at retail (B2C); submitting dealership applications; price, stock and order management for dealers; and an online support assistant for product questions.

2.3. There is no customer membership. No account is needed to shop — orders are placed as a guest. Membership provisions (Article 4) apply only to dealer portal accounts.

2.4. Platform features may be developed, changed or removed over time; core service delivery is preserved.

2.5. Age limit: you must be 18 or older to place an order.

ARTICLE 3 — ORDERS, PRICES AND PAYMENT

3.1. Ordering, payment, delivery, withdrawal and returns are governed by the Distance Sales Agreement, Preliminary Information Form, Delivery & Shipping Terms and Cancellation, Return & Withdrawal Policy, which form an integral part of this agreement.

3.2. Retail (B2C) prices include VAT. Wholesale (B2B) prices address commercial buyers and are shown excluding VAT; VAT is calculated in the order summary and the payment step always shows the VAT-inclusive final amount.

3.3. Payments are collected with 3D Secure through the licensed payment institution PayTR Ödeme ve Elektronik Para Kuruluşu A.Ş. Card data is never seen or stored by BURTECH.

3.4. BURTECH operates no automatically renewing subscription and no recurring billing. Each order is charged once, separately.

3.5. In case of a manifest error in prices or stock, BURTECH reserves the right to cancel the order and refund any amount charged.

ARTICLE 4 — DEALER PORTAL ACCOUNTS

Dealer accounts are created only by BURTECH; there is no self-registration. Dealers are fully responsible for the security of their credentials and for the accuracy of the prices and stock they publish, must keep price lists and customer data confidential, must report suspected unauthorised access to info@burtech.com.tr immediately, and lose portal access when the dealership ends.

ARTICLE 5 — USER OBLIGATIONS

Users undertake to use the Platform lawfully and to provide accurate information. The following are prohibited: sharing false, misleading or harmful information; unauthorised use of another person's identity, card or account; uploading malware; automated scanning, scraping or catalogue copying; probing the Platform's security or attempting to disrupt it; payment fraud and abusive chargebacks; spam. Users also undertake to use, store and dispose of the chemical and technical products in line with the packaging instructions and the Safety Data Sheet (SDS), and to keep their contact details up to date.

ARTICLE 6 — BURTECH'S OBLIGATIONS

BURTECH endeavours to provide the Platform continuously and securely, performs regular maintenance and updates, processes personal data in line with KVKK using secure servers and SSL/TLS, makes the notifications required by KVKK in case of a data breach, and answers support requests at info@burtech.com.tr within 48 hours (24 hours for technical issues, 15 days for consumer complaints, 30 days for KVKK applications).

ARTICLE 7 — INTELLECTUAL PROPERTY

All software, design, interface, text, product imagery, catalogue content and the "BURTECH" mark and logo belong to BURTECH KİMYA SANAYİ VE TİCARET LİMİTED ŞİRKETİ. Users receive a limited, non-transferable, non-exclusive right to use the Platform for shopping and information purposes. Copying, reproducing, distributing, republishing, reverse-engineering or commercially exploiting the content without written permission is prohibited. Dealers may use BURTECH marks and imagery only within their dealership activity and according to BURTECH's rules.

ARTICLE 8 — LIMITATION OF LIABILITY

BURTECH is not liable for interruptions caused by force majeure (natural disaster, fire, flood, epidemic, war, terrorism, civil unrest, strike, cyber attack, power or internet outages, decisions of public authorities), for outages of third-party services (payment institution, maps, e-mail, carrier tracking), or for damage arising from use contrary to the packaging instructions and the SDS. BURTECH's maximum liability under this agreement cannot exceed the amount paid for the relevant order, and no liability is accepted for indirect damage, loss of profit or loss of data. Consumers' rights under Law No. 6502 and liabilities arising from mandatory legislation are reserved. The online support assistant provides guidance only and is not a binding commitment; the order summary and contract texts are binding.

ARTICLE 9 — PERSONAL DATA

Personal data is processed under the KVKK Privacy Notice, the Personal Data Protection & Processing Policy and the Privacy Policy published on the site. Processing that requires explicit consent (location data for finding the nearest dealer, commercial electronic messages, non-essential cookies) is collected through separate checkboxes, and does not take place without consent. Consent may be withdrawn at any time by writing to info@burtech.com.tr, with effect for the future. Rights under Article 11 of KVKK may be exercised via the Data Subject Application Form; applications are concluded free of charge within 30 days.

ARTICLE 10 — COMMERCIAL ELECTRONIC MESSAGES

Commercial electronic messages are only sent with prior consent under Law No. 6563. Every message offers a free opt-out, applied within 3 business days at the latest. Transactional notices (order confirmation, payment and delivery notifications) do not require consent as they form part of contract performance.

ARTICLE 11 — TERMINATION AND RESTRICTION OF ACCESS

BURTECH may restrict access temporarily or permanently where prohibited activities, payment fraud, chargeback abuse, attempted cyber attacks or infringement of third-party rights are established. Restriction does not affect delivery obligations for paid orders or consumers' statutory rights. Dealer accounts are closed within 7 business days of a request sent to info@burtech.com.tr.

ARTICLE 12 — CHANGES

BURTECH may update this agreement due to legislative changes or service improvements. The current text is published on the Platform and takes effect on publication. Changes are not retroactive: completed orders are governed by the text in force at order time. Material changes are announced 15 days in advance where possible.

ARTICLE 13 — DISPUTES

Turkish law applies. Consumers may apply to the Consumer Arbitration Committee or Consumer Court at their place of residence or purchase. For commercial disputes, the courts and enforcement offices at BURTECH's registered address are competent.

ARTICLE 14 — MISCELLANEOUS

This agreement forms a whole with its annexes. Invalidity of one provision does not affect the others. Non-exercise of a right is not a waiver. Users may not assign their rights and obligations. Electronic acceptance satisfies the written-form requirement under Law No. 6563. Records are kept for 10 years and constitute evidence. The governing language is Turkish.
