Distance Sales Agreement

This is a courtesy translation. In case of any discrepancy, the Turkish text of the Distance Sales Agreement prevails.

ARTICLE 1 — PARTIES

1.1. SELLER

The natural or legal person identified by the name/title, delivery and invoice address, phone number and e-mail address declared in the order form and at the payment step.

ARTICLE 2 — SUBJECT

This agreement sets out the rights and obligations of the parties under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the products ordered electronically by the Buyer through https://www.burtech.com.tr.

The Buyer confirms having read and electronically acknowledged the preliminary information — including the essential characteristics of the products, the sales price, payment method, delivery terms, the right of withdrawal and complaint channels — before placing the order.

ARTICLE 3 — PRODUCTS AND PAYMENT

3.1. Product names, quantities/pallet counts, unit of sale, VAT-inclusive price and the total amount appear in the order summary and in the order confirmation e-mail; they form an integral part of this agreement.

3.2. Prices are displayed per channel: retail (B2C) prices include VAT and are the final amount charged; wholesale (B2B) prices are shown excluding VAT because they address commercial buyers, and VAT is added in the order summary so the payment step always shows the VAT-inclusive final amount.

3.3. Payment methods: credit/debit card via the 3D-Secure virtual POS of PayTR Ödeme ve Elektronik Para Kuruluşu A.Ş.; PayTR payment link; bank transfer / corporate payment instruction (wholesale channel only).

3.4. Card data is never seen, processed or stored by the Seller. Payment takes place on PayTR's PCI-DSS compliant infrastructure; only the transaction result and reference data (such as the last four digits of the card) are transmitted to the Seller.

3.5. The invoice is issued according to the invoice details provided at order time and is delivered with the product or by e-mail. Errors must be reported to info@burtech.com.tr within 7 days of delivery.

3.6. Shipping and any other charges are shown separately in the order summary. No amount not shown in the order summary is charged to the Buyer.

ARTICLE 4 — GENERAL PROVISIONS

4.1. The Buyer declares having read the preliminary information and given the required electronic confirmation.

4.2. Delivery is completed by handing the product to the Buyer or to the person at the address indicated by the Buyer, within the statutory maximum of 30 days. Channel-specific lead times are stated in "Delivery & Shipping Terms".

4.3. Retail (B2C) orders are prepared and delivered by the authorised BURTECH dealer chosen by the Buyer, acting as the Seller's performance assistant; the Buyer's statutory rights against the Seller are reserved. Wholesale (B2B) orders ship directly from the factory.

4.4. Delivery requires this agreement to be confirmed electronically and the price to be paid. If the price is not paid or is cancelled in the bank records, the Seller is released from the delivery obligation.

4.5. If, after delivery, the Buyer's card is used unlawfully by unauthorised third parties without fault of the Buyer and the bank therefore does not pay the price to the Seller, the Buyer shall return the delivered product within 3 days, with shipping costs borne by the Buyer.

4.6. In force-majeure situations the Seller notifies the Buyer in writing within 3 days of becoming aware. The Buyer may then cancel the order, ask for an equivalent product, or postpone delivery. Amounts paid for cancelled orders are refunded within 14 days at the latest.

4.7. If an ordered product turns out to be out of stock, the Seller informs the Buyer immediately and refunds the amount paid within 14 days at the latest.

4.8. For defective products the Buyer may exercise the optional rights under Article 11 of Law No. 6502 (withdrawal, price reduction, free repair, replacement with a defect-free equivalent).

4.9. The products sold are chemical and technical products. The Buyer undertakes to use, store, transport and dispose of them in accordance with the instructions on the packaging and, where applicable, the Safety Data Sheet (SDS). The Seller is not liable for damage arising from use contrary to those instructions.

4.10. Persons under 18 may not place orders through this site.

ARTICLE 5 — RIGHT OF WITHDRAWAL

5.1. A Buyer qualifying as a consumer may withdraw from the contract within 14 days of delivery, without any justification and without incurring any penalty.

5.2. Notice of withdrawal sent within that period to info@burtech.com.tr or in writing to Pelitli Mah. Şantiye Cad. No: 10/1, 41400 Gebze / KOCAELİ is sufficient. The model withdrawal form published under "Cancellation, Return & Withdrawal" may be used but is not mandatory.

5.3. The product must be returned unused, with its invoice and accessories, in unopened packaging with the safety seal intact. The Seller refunds the total amount within 14 days of receiving the withdrawal notice and collects the goods within 20 days.

5.4. Refunds are made using the original payment method at no cost to the Buyer. The time it takes for a card refund to appear on the statement depends on the issuing bank.

5.5. Where the Buyer uses the carrier designated in "Delivery & Shipping Terms", return shipping is at the Seller's expense; if another carrier is chosen, the cost is borne by the Buyer.

5.6. Wholesale (B2B) purchases made for commercial or professional purposes are not consumer transactions, so no right of withdrawal applies. Cancellation of such orders is subject to the Seller's approval, without prejudice to remedies for defective or incomplete performance.

ARTICLE 6 — EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

Under Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for:

• Products whose packaging, tape, seal or protective film has been opened after delivery and whose return is not suitable for health and hygiene reasons — this includes aerosol and liquid chemical products whose safety seal or packaging has been opened.
• Products prepared to the Buyer's specifications, including custom filling or custom labelling.
• Perishable products or products with an expiry date.
• Products that are, by their nature, inseparably mixed with other items after delivery.
• Products whose price depends on fluctuations in financial markets beyond the Seller's control.

These exceptions do not affect the Buyer's statutory rights where a product is defective, incomplete or undelivered.

ARTICLE 7 — DEFAULT

If the Buyer defaults on a card transaction, the Buyer will pay interest under the credit card agreement with the issuing bank and be liable towards that bank. The Buyer is liable for any loss suffered by the Seller as a result of the Buyer's default.

ARTICLE 8 — PERSONAL DATA

Personal data shared during the order and payment process is processed under Law No. 6698 and the "KVKK Privacy Notice" and "Privacy Policy" published on the site. Payment data is shared with PayTR and delivery data with the carrier and, in the retail channel, with the selected authorised dealer.

ARTICLE 9 — DISPUTE RESOLUTION

Turkish law applies. Consumers may apply to the Consumer Arbitration Committee or the Consumer Court at their place of purchase or residence, within the monetary limits announced annually by the Ministry of Trade. For commercial (non-consumer) sales, the courts and enforcement offices at the Seller's registered address are competent.

ARTICLE 10 — ENTRY INTO FORCE

This agreement consists of 10 articles and enters into force when the Buyer accepts it electronically and completes the order by payment. A copy is sent with the order confirmation e-mail and retained by the Seller for 10 years. Electronic acceptance satisfies the written-form requirement under Law No. 6563.
